MoodAI Music Terms of Service

Welcome to MoodAI Music, a digital music generation service owned and operated by Jujosoft LLC ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of MoodAI Music, including any tokens purchased through the platform and any music generated by our AI system.

By accessing or using MoodAI Music, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Service Overview

MoodAI Music provides AI-generated music tracks that users can access by purchasing tokens. These tracks are available for royalty-free use under the terms described below.

2. Token System

• Tokens are digital credits used to generate music through the MoodAI Music app.
• Tokens can be purchased and are non-refundable.
• Tokens are not currency and hold no monetary value outside the platform.
• Tokens are non-transferable between user accounts.
• We may offer free or promotional tokens at our discretion.
• Unused tokens do not expire.

3. License to Generated Music

• You receive a perpetual, non-exclusive, royalty-free, worldwide license to use the music generated for personal and commercial projects.
• Permitted uses include videos, podcasts, advertisements, games, websites, and multimedia projects.
• You may not sell the music as standalone tracks or claim exclusive rights.
• You may not use the generated music in illegal, infringing, or harmful ways.

4. User Conduct

You agree not to:

• Use MoodAI Music for illegal or unauthorized purposes.
• Reverse-engineer, exploit, or interfere with the AI system or platform.
• Use automation, bots, or scrapers to access or use the service.
• Generate music using prompts intended to copy copyrighted works or impersonate artists.

5. Intellectual Property

The MoodAI Music platform, including its technology, design, interface, and AI models, is the intellectual property of Jujosoft LLC. The music you generate is licensed to you under Section 3, but the underlying system and service remain our property.

6. Disclaimers

• MoodAI Music is provided "as is" with no warranties of any kind.
• We do not guarantee uniqueness or suitability of any generated content.
• Similar or identical music may be generated for different users.
• We are not responsible for third-party claims resulting from your use of generated music.

7. Limitation of Liability

To the fullest extent allowed by law, Jujosoft LLC is not liable for any indirect, incidental, special, or consequential damages, including lost profits or data, arising from your use of the MoodAI Music service.

8. Account Termination

We reserve the right to suspend or terminate any user account that violates these Terms, engages in fraud, or abuses the system. Unused tokens may be forfeited upon termination.

9. Changes to Terms

We may update these Terms at any time. Continued use of the service after updates constitutes acceptance. Please review them regularly.

10. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws principles.

11. Dispute Resolution and Arbitration

Any dispute related to these Terms or MoodAI Music will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will be held in Dallas County, Texas.

You waive your right to a jury trial and agree not to bring claims as part of a class action.

You may bring a claim in small claims court in Dallas County, Texas, if your dispute qualifies.

12. Indemnification

You agree to indemnify and hold harmless Jujosoft LLC, its officers, employees, and affiliates from any claims, losses, or damages arising from your use of MoodAI Music, violation of these Terms, or infringement of any third-party rights.

13. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, internet outages, government restrictions, or labor strikes.

14. Age Restrictions

You must be at least 13 years old to use MoodAI Music. If you are under 18, you may use the service only with the consent of a parent or legal guardian. We do not knowingly collect data from children under 13.
